FUELERLINX Fuel Price Analysis Software License Terms of Use

The FUELERLINX™ Fuel Price Analysis Software (the "Software") licenses hereby is intended for use only by flight departments that subscribe to contract fuel. No other use of the Software is intended, approved or authorized by FUELERLINX™.

When you agree to our license terms of use, we confer a limited non-transferable non-exclusive license for your use of the Software. You may not copy, duplicate, transfer, reverse-engineer this software, modify it, change the design, rename it, use it for any commercial purpose, or charge for its use. FUELERLINX™ does not warrant this Software's performance in any way, and FUELERLINX™ expressly disclaims all representations, warranties, and conditions, expressed, implied, statutory, or otherwise pertaining to the Software, including, but not limited to, implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. FUELERLINX™ will not be liable for any damages resulting from the downloading or use of this Software. FUELERLINX™ expressly reserves the right to use the Software, and related information and technology for any purpose which it deems appropriate in its sole discretion, includng without limitation, educational, research, scientific and other nonbusiness purposes, and to publish or otherwise dissmeinate the Software. FUELERLINX™ also reserves the right to duplicate, copy, transfer, sell, license or otherwise make use of the Software for any purpose that FUELERLINX™ in its sole discretion deems appropriate. You will not acquire or obtain any rights in and to the Software, including rights of copyright, trademark or any other intellectual property rights and FUELERLINX™ shall retain all such intellectual property rights in and to the Software. This license is the entire agreement between FUELERLINX™ and you, and supersedes any other communications or advertising with respect to the Software ; this license may be modified only by written agreement signed by authorized representatives of you and FUELERLINX™. If any provision of this license is held invalid, the remainder of this license shall continue in full force and effect. All rights not expressly granted in this agreement are retained by FUELERLINX™.
